Apply for local jurisdiction / certificate of inheritance:
The court (probate court) in whose district the testator had his last habitual residence is generally responsible for applying for the certificate of inheritance (correctly: accepting the affidavit in the application for the certificate of inheritance). The application for the certificate of inheritance can also be submitted to the court of the heir's place of residence or via a notary (not a lawyer).
Local jurisdiction / renunciation of inheritance:
The court of the deceased's last usual place of residence is responsible. The renunciation of the inheritance can also be made at the probate court at the renouncer's place of residence. The renunciation can also be declared at any notary - at no additional cost other than VAT. The renunciation must be received by the responsible probate court within the 6-week renunciation period from the time of knowledge of the inheritance and the reason for being appointed as heir. The renouncer receives an invoice to pay the fee for renunciation of the inheritance. Cash or card payments are not possible on site. The fee depends on the estate assets and is taken from a fee table.
Submitting an application to make an appointment for a renunciation of inheritance does not meet the deadline.
The renunciation of an inheritance by minors must be done by the legal representatives at the probate court. In some cases, approval from the family court may be required, which must be applied for at the family court after the renunciation.
Renunciation of inheritance with residence abroad:
Heirs residing abroad can apply for renunciation of inheritance either personally at the responsible local court, through a notary or through the German consulate.
Note for wills:
Wills that are to be kept can be sent to the district court by post or deposited at another Hamburg district court. The will can be kept at the district court of the testator's choice.
Legal advice:
Legal advice is not available at the probate court. Please contact the people authorized to provide legal advice. These are lawyers or notaries. The Public Legal Advice Service (ÖRA) offers inexpensive legal advice for people on low incomes.
