The Youth Welfare Office offers you, as the person with custody, advice to resolve conflicts concerning your child as early as possible and to avoid legal disputes.

The Youth Welfare Office plays an important role in family court proceedings, for example in disputes over custody, access or the place of residence of your child.

If proceedings have already been initiated at the family court, the youth welfare office can provide you with advice and support and help you develop amicable solutions.

The youth welfare office is commissioned by the family court to provide an opinion in family court proceedings. The youth welfare office's task is to protect the well-being of your child and to ensure that the court makes a decision that corresponds to the needs and interests of your child. To this end, there is an intensive exchange between you, the youth welfare office and the court.

The youth welfare office can also support you after the procedure has been completed. It can oversee the implementation of court decisions to prevent further conflicts. The youth welfare office can also offer you mediation and advice to promote communication between you and all those involved.

Deadlines

There are no generally applicable deadlines. The family court may set deadlines for you as part of the proceedings.

Procedure

  • If you as parents cannot resolve a conflict on your own and you turn to the family court, the youth welfare office will automatically be involved by the court.
  • In Hamburg, the Youth Welfare Office forwards this request for support to the responsible independent youth welfare organizations.
  • The provider's staff will contact you to have a conversation and assess the child's situation.
  • They then prepare a report that is submitted to the family court. This report contains an assessment of your child's well-being and, if necessary, recommendations for further action.
  • The employees of the independent organizations also take part in the court hearing to explain their assessments and recommendations in more detail and to answer questions from the court.
  • The youth welfare office or the appointed agency often remains involved even after the hearing in order to accompany the implementation of the court decisions and prevent additional conflicts

There are no costs for advice and support from the youth welfare office. Costs may be incurred for the proceedings at the family court.
