Apply for exemptions from the Industrial Safety Ordinance when using work equipment

If you as an employer can only implement certain protective measures of the Occupational Safety and Health Ordinance with very high, disproportionate effort, you can apply for an exemption from the Occupational Safety and Health Ordinance.

Detailed description

You can apply for an exception to the Industrial Safety Ordinance if the application of the regulations would lead to disproportionate hardship in an individual case. The exception must be justifiable from a safety perspective and compatible with the protection of employees and, where systems requiring monitoring are concerned, also with the protection of other persons.

Prerequisites

You will receive an exemption if

  • the application of the regulations would lead to disproportionate hardship for you as an employer in individual cases,
  • the exception is justifiable from a safety perspective,
  • the exception is compatible with the protection of employees and, as far as installations requiring monitoring are concerned, also with the protection of other persons.

Documents required

You must submit a written application containing the following information:

  • the reason for requesting the exemption
  • the activities and procedures concerned
  • the number of employees likely to be affected
  • the technical and organisational measures to be taken to ensure safety and avoid hazards

If necessary, the responsible authority will request an expert report from you.

The Office for Occupational Safety and Health grants exceptions for all other work equipment.

  • Your application is being reviewed.
  • If necessary, further documents or information will be obtained from you.
  • If necessary, an expert opinion will be requested.
  • The responsible authority will decide on your application.
  • You will receive a notification from the responsible authority.

Processing time

If all documents are complete, processing time is 4 weeks.

Fees

Fees and expenses are charged according to actual expenditure.


If an expert report is required, you will have to bear the costs.

Objection within 4 weeks after you have received the decision.
